রেলওয়েতে ক্ষতিকর বা নাশকতামূলক কর্মকাণ্ডের পুলিশি তদন্ত : ২২৫ :
Police inquiries into malicious mischief, and on the Railway : 225 :
(ক) যেসব তদন্তে রেলওয়ে কর্মচারীরা অভিযুক্ত বা সাক্ষী হিসেবে জড়িত থাকেন, সেগুলো এমনভাবে পরিচালনা করতে হবে যাতে রেলওয়ের দায়িত্ব পালনে যথাসম্ভব কম বিঘ্ন ঘটে। উপযুক্ত কর্তৃপক্ষকে নোটিশ না দিয়ে এবং কর্মচারীর বিকল্প ব্যবস্থা (রিলিফ) করার জন্য পর্যাপ্ত সময় না দিয়ে পুলিশ কোনো রেল কর্মচারীকে তদন্তের উদ্দেশ্যে তার দায়িত্ব বা কর্মস্থল ত্যাগ করতে বাধ্য করতে পারবে না।
(a) Inquiries in which railway servant are concerned either as accused or as witnesses, must be conducted so as to interfere as little as possible with railway duties. No person employed by the Railway shall be required by the police to leave his duty for the purpose of an investigation, unless notice shall have been given to the proper authority, and reasonable opportunity allowed to arrange for his relief.
ফৌজদারি কার্যবিধির ১৭০ ধারা অনুযায়ী, একজন তদন্তকারী police কর্মকর্তা কোনো রেলওয়ে কর্মচারীকে আদালতে বাদী বা সাক্ষী হিসেবে উপস্থিত হওয়ার জন্য মুচলেকা (bond) নিতে পারেন। তবে ৭২ ধারা অনুযায়ী কোনো রেল কর্মচারীকে তার কার্যালয় প্রধানের মাধ্যমে সমন পাঠানো ছাড়া সরাসরি তলব করা সমর্থনযোগ্য নয়।
Section 170 , code of Criminal procedure, empowers an Investigation police officer to take a bound from a railway servant for his appearance in court as prosecutor or witness . Section 72 does not justify a railway summoned through the head of his office.
(খ) প্রত্যেক রেলওয়ে কর্মচারী তার নিজস্ব বিভাগের কোনো দায়িত্বশীল ব্যক্তির উপস্থিতিতে পুলিশের কাছে জবানবন্দি বা বিবৃতি দিতে বাধ্য থাকবেন। এই বিবৃতি কোনো ঊর্ধ্বতন কর্মকর্তার পূর্বানুমতি বা রেফারেন্স ছাড়াই অবিলম্বে এবং সম্পূর্ণভাবে দিতে হবে। বিবৃতি দিতে অস্বীকারকারী যেকোনো ব্যক্তি দণ্ডবিধির ১৭৬ ধারার দ্বিতীয় অংশে বর্ণিত শাস্তির মুখোমুখি হবেন।
(b) Every railway employee is bound to give his statement to any member of the police, when called upon to do so in the presence of a responsible person of his own department. The statement is to be given promptly and fully and without previous reference to any officer.Any person refusing to give his statement, lays himself open to the penalty laid down in the second part of section 176 of the Pakistan penal Code.
